The below provisions constitute the privacy policy (further on: “Privacy Policy”), which defines the terms regarding data collection including personal data of the users who use service(s) provided by ALWO sp. z o.o. based in Warsaw at Al. The legal foundation of processing the personal data is article 23 section 1 point 5 from Act of 29 August 1997 about the protection of personal data and since 25 May 2018 it will be Art. 6. section 1(f) of European Parliament and the Council of the European Union Regulation 2016/679 since it is processing in “administrator’s

  6. ALWO uses cookies which facilitate raising the quality of the services provided by ALWO thanks to storing users’ preferences. Cookies do not identify the personal data of the user, do not have impact on functioning of the end-device or its software. Cookies are a chain of signs, which is sent from ALWO ICT system to user’s computer while running the website by the browser.

ALWO uses two principal kinds of cookies: “session” cookies and “persistent” cookies. “Session” cookies are temporary files which are stored in the user’s end-device until the logout, leaving the webpage or turning off the software. “Persistent” cookies are stored in the user’s end-device for the period determined in the parameters of the cookie files or until the deletion by the user.

In principle, Local Storage technology is close in its performance and function to cookie files, however, in opposition to cookie files storing data in Local Storage has a long-term character, i.e. it does not have a default timeout period. Moreover, data stored in the Local Storage is not sent from the end-device to the server in an automatic way, like it is in the case of cookie files, but can only be downloaded via the webpage, by which they were previously saved.

While using the tools provided by browser available on the market, one can at any time from the level of privacy settings, change the settings regarding cookie files as well as other technologies used to store data (including Local Storage technology), particularly in such a way as to block their automatic support in particular browsers and plugins, alternatively – depending on used technology and tool – inform whenever they are placed in user’s end device.   15. ALWO also enables access to apllications shared by third parties. The data collected by ALWO after turning on the application, is processed according to Privacy Policy. The data collected by the provider of such and app is covered by the privacy policy of a third party.
  16. Moreover, ALWO might use the collected data:
    1. for developing new functionalities within the framework of the service provided as well as its perfecting;
    2. for creating new services;
    3. for protecting the rights of ALWO;
    4. If it is indispensable, for the completion of the legal interests realised by ALWO or data’s recipients when the processing does not violate the rights and liberties of the person concerned.
  17. ALWO guarantees that the personal data transmitted will not be shared with third parties unless:
    1. The obligation of sharing the personal data results from the provisions of laws or when the data transmitted serves the objectives of protecting ALWO or deciding a dispute; or:
    2. the user gave his/her consent for transmitting the personal data to third parties.
  18. However, ALWO declares that:
    1. the personal data might be shared with third parties, by the aid of whom ALWO performs particular functions appropriate for conducting day-to-day operations, e.g. settling or sending prizes in competitions. ALWO exercises the utmost care that the third parties, with whom the personal data is disclosed in the objective described above, treat the transmitted data in accordance with Privacy Policy and in the way which is compliant with the existing provisions of law;
    2. the data, other than personal data, including cookies, might be shared with third parties – current and potential trading partners of ALWO.
    3. personal data and data other than personal data might be shared with third parties in case of user’s using an application shared by third parties, about which the user is notified before using a particular application. Transferring the data from ALWO ICT system happens in such a case at risk and on request of the user.

ALWO uses technical and organisational measures which aim at the best protection of the personal data collected by ALWO against unauthorised access or misuse by unauthorised parties. The technical means applied are being modernised with development of new technologies, new needs as well as available means of protection. The organisational means applied ensure that in ALWO structures only authorised persons have the access to user’s personal data. ALWO regularly controls the correspondence of their activities with the appropriate provisions of law and Privacy Policy. ALWO cooperates with the state institutions responsible for the control of gathering and processing the personal data and each time they implement their prospective recommendations.
